  2. Major Party Status and Ballot Access by Leonard Schwartz

    "Principal Candidate," Major Party Status, and Ballot Access

    Some persons are confused about whether Public Act 399, enacted a few weeks ago, affects our ability to achieve and maintain major party status. This article clarifies the effects of PA 399.

    "Principal candidate" is defined twice in Michigan's Election Law, in sections 168.532 and 168.685. Prior to passage of PA 399, the definition was the same in both sections. The principal candidate is the candidate whose name appears "nearest the top of the party column."

    PA 399 changed the definition only in section 168.685, which concerns ballot access. "Principal candidate" now is the candidate "who receives the greatest number of votes of all candidates of that political party for that election." This change eliminated our top-of-ticket problem for ballot access.

    PA 399 did not change the definition in section 168.532, which concerns major party status. To get and maintain major party status, our top-of-ticket candidate must get 5% of the votes cast for all candidates for secretary of state in the most recent election for secretary of state.

    This year our top-of-ticket candidates are Diane Barnes and Scotty Boman, who are running for the state Board of Education. If either of them gets enough votes, we will have major party status. But we would lose major party status in 2004 if our candidate for president did not get enough votes.

    The LEC is attempting to prepare a slate brochure listing all Michigan LP candidates in the November 2002 general election.
